qMateria Acceptable Use Policy

Short version: The qMateria platform is designed exclusively for professional use within the construction industry. While using the Service Package, you must comply with our Acceptable Use Policy, which includes restrictions on content and conduct related to user safety, intellectual property, privacy, data quality, professional responsibility, and other limitations. Access is strictly limited to named Users with valid company email addresses. In short, use the platform professionally and responsibly.

1. Compliance with Laws and Regulations

You are responsible for using the Service Package in compliance with all applicable laws and regulations, including but not limited to UK GDPR, the Data Protection Act 2018, the Computer Misuse Act 1990, all applicable professional codes of conduct, and this Acceptable Use Policy. You shall not use, or encourage, promote, facilitate, or instruct others to use the qMateria platform or Service Package for any illegal, harmful, or unauthorised purpose, and your content must not be illegal, harmful, or otherwise contrary to this policy. These policies may be updated from time to time.

2. Professional Use and User Safety

We do not allow content or activity on the qMateria platform, its products, or services that:

  • Is unlawful or promotes unlawful activities
  • Is harmful to others, including qMateria, its operations, or reputation
  • Is libellous, defamatory, or fraudulent
  • Is discriminatory or abusive toward any individual or group
  • Is false, inaccurate, or intentionally deceptive information
  • Harasses or abuses another individual or group, including our employees, officers, agents, or other users
  • Threatens or incites violence toward any individual or group
  • Interacts with platform features in a way that significantly or repeatedly disrupts the experience of other users
  • Is submitted by an individual using personal email credentials — all registrations must use a valid company email address

3. Intellectual Property, Authenticity, and Private Information

We do not allow:

  • Any content or activity on the qMateria platform that infringes any proprietary right of any party, including patent, trademark, trade secret, copyright, right of publicity, or other right
  • Attempts to imitate the "look and feel" of the qMateria platform or its products or services
  • Deletion or alteration of any notices or notifications from the platform or Data Outputs that refer to intellectual property rights, brand names, or qMateria's unique project reference numbers
  • Uploading any content that is subject to a licence that would restrict qMateria's ability to process it in accordance with the MSA
  • Use of the platform in a way intended to avoid or work around any use limitations and restrictions placed on the platform, products, or services
  • Access to or use of the platform for the purpose of conducting a performance test or building a competitive product or service
  • Access to the platform from any location prohibited by or subject to sanctions or licence requirements according to applicable sanctions and/or export control laws and regulations
  • Content or activity that impersonates any person or entity, including any of our employees or representatives, or fraudulently misrepresents your identity or your organisation's purpose
  • Content or activity that violates the privacy of any third party, such as uploading another person's personal information without consent or a valid lawful basis under UK GDPR

4. Spam Activity

We do not allow content or activity on the qMateria platform that is:

  • Automated excessive bulk activity or coordinated inauthentic activity, such as spamming
  • Bulk distribution of promotions or advertising
  • Inauthentic interactions, such as fake accounts or automated inauthentic activity
  • Use of the platform as a vehicle for propagating abuse on other platforms
  • Phishing or attempted phishing
  • Use of our servers for any form of excessive automated bulk activity, placing undue burden on our servers through automated means, or relaying any form of unsolicited advertising or solicitation through our servers

5. Platform Access and Safety

We do not allow content or activity on the qMateria platform that:

  • Directly supports unlawful active attack or malware campaigns causing technical harms — such as using our platform to deliver malicious executables or as attack infrastructure, for example by organising denial of service attacks or managing command and control servers
  • Uses our servers to disrupt or to attempt to disrupt, or to gain or to attempt to gain unauthorised access to, any service, device, data, Account, or network
  • Attempts to disassemble, decompile, reverse engineer, or derive the source code, AI model configurations, data processing methodologies, or proprietary workflows embedded in the platform
  • Tampers with or attempts to circumvent or disable any authentication, access control, or security mechanism of the platform

6. Privacy

Misuse of personal information is prohibited. You must ensure that all data uploaded to the platform as Your Content complies with applicable Data Protection Laws and that you have all required legal bases to process and transfer such data to qMateria in accordance with the MSA and DPA. You must not upload personal data beyond what is necessary for the purposes of the engagement.

7. Professional Responsibility and Data Outputs

You must not engage in activity that significantly harms other users or that misrepresents the nature or authority of qMateria's Data Outputs. In particular:

  • You must not represent qMateria's Data Outputs as constituting professional engineering certification, structural design approval, or any other form of regulated professional opinion
  • You must ensure that Data Outputs are reviewed and validated by appropriately qualified professionals within your organisation before being incorporated into cost plans, procurement decisions, or any client-facing deliverables
  • Trial and Standard Tier Data Outputs are indicative only and must not be used in professional deliverables without independent verification
  • You are solely responsible for all professional decisions made on the basis of Data Outputs and for their incorporation into your work

We will interpret our policies and resolve disputes in favour of protecting users and the professional integrity of the platform as a whole.

8. Reporting

If you become aware of any violation of this Acceptable Use Policy, you will immediately notify us at admin@qmateria.io and provide us with reasonable assistance, as requested by us, to stop, mitigate, or remedy the violation.
